A distressed sale is the term given to a sale that is under a time constraint (e.g., legal proceeding commenced) or forced by interest holders other than the fee owner of the property (lien foreclosure). Most of these properties are available in MLS and many of them are bank owned properties. Often in a foreclosure sale, the lien holder will become the title holder of the property by purchasing it themselves at public auction. A true foreclosure sale is one that occurs through either lender rights in the deed of trust or pursuant to a court order. These sales require cash offers and are subject to a 10 Upset Bid period.
